RECOMMENDATION:


It is respectfully recommended that for Count III, 422.6 PC
(Intimidate/Threaten/Oppress because of Race/Religion/Color),
misdemeanor, Keith Henson, HEM014371, be placed on formal probation
for a period of five (5) years, under the following terms and
conditions:

(1)	Obey all laws and ordinances; (1)

(2)	Be committed to the custody of the Sheriff of Riverside County
for a Moderate period of time, 200 days; (AB)

(3)	Pay restitution in an amount to be determined, payable through
the Court, as directed by Financial Services Division; any dispute as
to amount to be resolved in a court hearing; (CB1)

(4)	Submit to the immediate search of your person, automobile,
residence and surrounding premises, garage, storage areas and personal
property or leased property, with or without reasonable cause; for the
detection of explosives/weapons of mass destruction/personal computer
and files containing any terrorist threats; by the Probation Officer
or any law enforcement officer; (EB1)

(5)	Report any law enforcement contacts to the Probation Officer
within 48 hours; (H1)

(6)	Reside at a residence approved by the Probation Officer and
not move without prior consent of the Probation Officer; (HC)

(7)	Not have any direct or indirect contact with the victim(s), or
any property owned or controlled by Church of Scientology; (HD)

(8)	Participate and complete at your expense any counseling,
rehabilitation/treatment program deemed appropriate by Probation
Officer; and authorize release of information relative to progress;
(HF)

(9)	Not own, possess or have under your control or immediate
access to:
firearms or deadly weapon or weapon related paraphernalia or
incendiary
device; (HJ1)

(10)	Report to the Probation Officer immediately, or upon release
from custody for initial instructions and abide by all reasonable
directives of that officer; (HL)

(12)	Not annoy, molest, attack, strike, threaten, harass, stalk,
batter or disturb the peace of the victim. (MH)

Pay the costs of pre-sentence probation report, pursuant to 1203.1b
PC, in an amount and manner to be determined by Financial Services
Division; not to exceed $230.00; (XL)

Pay the costs of probation supervision pursuant to 1203.1b PC, in the
amount of .$252.00. If the level of probation supervision is modified,
these costs may be increased to an amount not to exceed $1,908.00;
(XM)

Pay Restitution Fine of $100.00 through the Clerk of the Court
pursuant to 1202.4 PC, as directed by Financial Services Division;
(YC)
